This was expected. Tancredo was a single issue candidate and most people of this good country are sensible. They see him for what he is. Economic hardships combined with lots of false information can easily bias even the most well meaning citizen.
He did manage to bring illegal immigration topic to prominence and promoted general hatred towards immigrants. Personally I am happy he is out and I hope this country will be spared from any further "public service" from this abominable politician.

My 485 is pending, so I think I won't be totally out of status..
Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?

My PD is not in this range. Mine is July-2001 kind of >= 2002.
I have seen an ALIA observation on EB2 Retro. Trying to figureout how soon these Visa #'s for EB2 catagory is vanished. I will have an analysis from this will post here.
This polls just captures two recent retors one for Jan & Other for Feb. I just pulled EB-2 dates from VB and thrown a random survey.

My Case as of March 2010:
EB3 (India) applied with company A. PD: June 2004.
Labor approved, I-140 approved.
No EAD. Labor was not approved when EB3 dates became current
First issue of H1B March 2003
Currently have a 3 year H1B extension (beyond 6 years) due to run out in Nov 2011.
My Questions:
1. I am still working with Company A. Can I move to Company B, i.e. will I be able to transfer my H1B, which is now in its 8th year? If yes, will the transfer be valid till Nov 2011?
2. If I can move to Company B, do I have to file for a new GC right away? If not, by when?
3. Can this new GC be EB2 with the hope of porting the PD from my EB3 case from Company A? If yes, what is the criteria for such a port?
4. Anything else I should keep in mind if I can and do decide to switch to Company B?
All your help is greatly appreciated!! I have been sitting and just waiting for my EB3 to get current, which does not seem like a possibility now. Hoping that I can use an EB2 case.

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

My company prepared for my PERM filing in EB2 category. They did all recruitement efforts. But at the time of filing, company annouced some lay-offs as "restructuring". Now my lawyer says, it is their policy not to file for PERM before six months of any lay -offs since some lay -offs involve same job title as my labor supposed to be filed. Since this is my lawyer's policy, My question is, is it safe to file PERM right now? What if I use different job title then the one my lawyer used before for recruitement efforts. (I understand he has to do new recruitement efforts for this ne job title, but is it safe?). What choices do I have, I do not want to delay my PERM filing. Please help...
