Dear all,
I have a Q regarding the follow-to-join rule. Say one has filed I-140 and I-485 recently (concurrently filing). To use the follow-to-join rule, can the spouse file I-485 at any time after the primary applicant's I-140 is approved but before I-485 is approved? In that case, will the spouse's I-485 be approved around the same time as the primary applicant?
A related Q, will a Visa number be immediately available after one's I-140 is approved?

A Non profit organisation is willing to sponsor H1 for my friend who is a Masters degree holder.
Can I get some info about the process to apply for H1 through a Non profit organisation.
I know it does not fall under the 65 k cap, but is unsure of the process and documents needed.

This info might be a little old. But I filed for PERM on Dec 1, 2010 and it got approved on Dec 19th, 2010. So, 18 days. Also, you can find the latest info for PERM approval processing time on www..com

I searched the forums briefly but could not find a similar case, please assist.
There is a requirement for me to take up another position with the same employer (sort of Lateral job transfer) with the following details:
My H1B is sponsored by State Government who I have been working for 6+ years.
PD=DEC 2002, EB3
485 Filed= JUNE 6, 2007
FP = JULY 17, 2007
The new position will be with:
Same Employer
Same Job Title
Same Job Description
Same Job Duties
Same Pay
Same Classification Code (internal state job code#)
Same Supervisor
Same Location physically same cabin
Same everything else I can think of.
ONLY THING DIFFERENT IS THE "POSITION NUMBER" that is assigned by the Personnel Department. There will be an internal advertising for the position and interview & selection process.
I would like to know:
1) Does accepting the position at this stage cause problem with the Green Card process, i.e, will it affect my I485, PD or anything else? I have waited 6+ years to get to this stage and obviously I do not want to take any kind of risk.
2) Do I need to inform or check with USCIS or any other agency about this position change?
3) Do I need to do anything else to protect my PD, AOS etc.
I would appreciate all the assistance I can get.

My perm from May-09 went to audit & was approved in April-11. I noticed the dates for audited cases are moving forward quickly & jumped 9 months from March-09 to December-09. As your date falls in the March-December range, I would wait until the end of this month and then contact the DOL. My reasoning is that your application is sitting on someones table (waiting to be approved). Good luck to you.

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

Hi,
I had a question about the H-1B cap. I am currently in F-1 status in
graduate school and am planning to finish my degree requirements
sometime in March/April 2007 and eventually need to be in H-1B status
to continue to work in the US.
I previously was in the H-1B status from Jan. 2001 till Sep. 2001 (9 months)
for which I was counted towards the FY2001 H-1B cap (more than 6 years ago).
In Sep. 2001, I switched to F-1 status to get a PhD and haven't been
outside the US for more than 4 weeks since then. My question is
will I be subject to the H-1B cap again, and get a new 6-year H-1B
term, if a for-profit employer files an H-1B petition for me for FY2008
?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and
not be counted against the H-1B cap ?

We are working on a document that details what gives advice on what we did and how we did it. As well as things we learned that we should have done!

My fianc�e lives in Mexico and I live in the United States. We are planning on getting married this summer. As soon as I return, I'm planning on beginning the process so that my future wife could come to the United States to live with me. We plan on getting married in the Catholic Church, but we have doubts if that type of marriage is a valid one for this specific situation. We just don't want a delay in the process simply because it was a religious marriage and we want to be with each other as soon as possible. My question is: Is a religious marriage valid for this situation? Which one would you recommend: Having a civil marriage or a religious marriage in Mexico?
I don't know about Mexico but, in India, most of the citizens have religious weddings and then, they register that with the Marriage Registrar's office to get a marriage certificate.

In fact the IV community was rejoicing when it fell through in the senate.
Now that CIR has been pushed ahead, IV can easily put forth the perspective of having a legislation specifically for the skilled community.
Lets look at it this way, CIR was an excuse used by a lot of politicians to avoid solving issues faced by the highly skilled community; with its demise they have one less excuse.
In fact the IV community was rejoicing when it fell through in the senate.

Its not true,
My daughter is 3years 5months old and she got FP notice and gave finger prints in Nov 2007. The only change for them is they will get FP Notice with Code 2[means they will take FP for only one hand] and we all get Code 3 FP notice.
